For example, they have the right to be tried for their alleged crimes within a reasonable time; if they are not, they may be able to assert that the State violated their right to a speedy trial, and, therefore, the charges against them should be dismissed. In a recent Florida <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca11\/22-10630\/22-10630-2023-09-06.html\" target=\"_blank\" rel=\"noopener\">opinion<\/a> issued in a case in which the defendant was charged with identity theft, the court discussed what a defendant making a speedy trial argument must prove to prevail. During his trial, the government alleged that the defendant, who was an attorney, obtained litigation advances from financing companies in the names of his clients without their knowledge and used the fraudulently obtained funds to pay his law firm&#8217;s expenses. The jury convicted the defendant of the charged offenses. He subsequently appealed on several grounds, including a violation of the Speedy Trial Act, insufficient evidence to support his convictions and an error in the jury instruction regarding deliberate ignorance.<\/p>\n<h2 style=\"font-weight: 400;\"><strong>The Speedy Trial Act<\/strong><\/h2>\n<div class=\"group w-full text-token-text-primary border-b border-black\/10 gizmo:border-0 dark:border-gray-900\/50 gizmo:dark:border-0 bg-gray-50 gizmo:bg-transparent dark:bg-[#444654] gizmo:dark:bg-transparent\" data-testid=\"conversation-turn-23\">\n<div class=\"p-4 justify-center text-base md:gap-6 md:py-6 m-auto\">\n<div class=\"flex flex-1 gap-4 text-base mx-auto md:gap-6 gizmo:gap-3 gizmo:md:px-5 gizmo:lg:px-1 gizmo:xl:px-5 md:max-w-2xl lg:max-w-[38rem] gizmo:md:max-w-3xl gizmo:lg:max-w-[40rem] gizmo:xl:max-w-[48rem] xl:max-w-3xl }\">\n<div class=\"relative flex w-[calc(100%-50px)] flex-col gap-1 gizmo:w-full md:gap-3 lg:w-[calc(100%-115px)] agent-turn\">\n<div class=\"flex flex-grow flex-col gap-3 max-w-full\">\n<div class=\"min-h-[20px] flex flex-col items-start gap-3 overflow-x-auto whitespace-pre-wrap break-words\">\n<div class=\"markdown prose w-full break-words dark:prose-invert light\">\n<p style=\"font-weight: 400;\">The Speedy Trial Act mandates that a defendant&#8217;s trial should start within seventy days from the indictment&#8217;s filing or the defendant&#8217;s initial appearance, whichever is later.<\/p>\n<p style=\"font-weight: 400;\">Regarding the Speedy Trial Act, the defendant contended on appeal that the time between filing a motion and the conclusion of the related hearing should not be excluded from the speedy trial calculation. However, the court noted that such time is, in fact, excludable under the Act.
